New changes to the Immigration, Asylum and Nationality Act will mean employers can serve a prison sentence of up to two years if they are found to have knowingly employed an illegal immigrant. On 29 February, a system of civil penalties for employers of illegal migrant workers will come into force, including a maximum penalty of £10,000 per worker for employers who fail to continually check employees’ legal rights to work in the UK. Lawyers are advising employers to implement an early warning system to prevent the need for last-minute action on migrant worker cases. Employers should draw up a letter inviting the employee to a meeting and detailing the basis for disciplinary action and indicating that a possible outcome of the meeting is dismissal.
